California is the game changer in the cannabis industry and is one of the most progressive states in the United States when it comes to Cannabis and Hemp. California was the first state in the U.S. to legalize medical cannabis 20 years ago and in January 2018 voters approved a measure to legalize cannabis for recreational use. As of 1 January 2018, adults aged over 21 can possess up to an ounce (28 grams) of the drug and can grow up to six cannabis plants at home.

Medical Cannabis in California

Medical Cannabis in California Ballot Proposition 215 received 56% ‘yes’ votes in November 1996, making California the very first state in America to legalize medical cannabis.

Cannabis for medical purposes is legal for any patients with either a written or oral recommendation from a physician stating that they will benefit from medical cannabis. Medical marijuana cards can be acquired through the California Department of Public Health, but are not required to purchase medical cannabis from a dispensary. Patients can possess up to 8 ounces of marijuana for any of the following conditions:

  • Arthritis Cachexia or Wasting Syndrome
  • Cancer Chronic Pain
  • Glaucoma
  • HIV/AIDS
  • Migraine Persistent
  • Muscle Spasms, including those associated with Multiple Sclerosis Seizures, including those associated with Epilepsy
  • Severe Nausea

California also allows medical cannabis for any chronic or persistent medical symptoms.

California led the nation in legalizing medicinal marijuana. Under California law, patients who meet certain requirements can obtain and use marijuana legally with a doctor’s recommendation. Medical use of marijuana/cannabis has been legal since Proposition 215, the “Compassionate Use Act,” passed in 1996 (Cal. Health & Safety (H&S) § 11362.5). These rules permit and regulate for-profit cultivation, distribution, manufacturing, testing, dispensary, and transportation, with permits required from both local and state agencies.  Temporary state licenses became available starting January 1, 2018.

For the most part, these rules do not affect individual patients, as long as they cultivate solely for personal medical use and limit their growing area to 100 square feet. Primary caregivers can cultivate up to 500 square feet for the personal medical use of up to five patients without falling under the new rules.

City and County Laws

Many cities and counties prohibit or regulate dispensaries and the cultivation of marijuana. Any county or city may have its own unique ordinances. Most are available on the internet.

Recreational Cannabis

Recreational Cannabis in California Voters passed Proposition 64 to legalize recreational cannabis under state law in November 2016. Under Proposition 64, adults aged 21 years and older can legally possess and use up to 28.5 grams (roughly 1 ounce) of cannabis and 8 grams of concentrated cannabis for recreational purposes. Adults are also allowed to cultivate up to six plants. Smoking is permitted in a private home, but remains illegal to use while driving a vehicle or when in public places. Cultivation of Cannabis in California Adults 21 and older can cultivate up to 6 plants for recreational purposes, under Proposition 64. California’s medical marijuana law allows qualified patients and their primary caregivers to cultivate 6 mature of 12 immature plants for medicinal reasons.
